A Stop Work Notice Sunroad Might Heed

Monday, June 4, 2007 | As most people know, Sunroad built an office tower in Kearny Mesa next to Montgomery Field. The Federal Aviation Administration determined, before the office tower was completed, that the height of the building exceeded safety standards and would be a hazard to air navigation. Sunroad ignored the FAA’s hazard notice and continued building.

On April 3, 2007, I joined with the Community Airfields Association and many other pilot organizations in urging Mayor Jerry Sanders to enforce the October 2006 stop work notice that had been issued to Sunroad.

Unfortunately, the mayor’s response to our urgent request was that he was “not sufficiently aware of the details of the project to respond.” This comment was unsettling for a number of reasons:

  • Sunroad’s office tower had been the subject of numerous news stories;


  • The mayor’s own staff in Development Services had issued two "stop work" notices -- one in October 2006, and another in December 2006;


  • There had been ongoing communications between the mayor’s staff and the Sunroad developer and lobbyists.
  • I also stated that it was time for Sunroad to be a good corporate citizen, remove the portion of its building that was determined by the FAA to be a hazard and put public safety ahead of private profit. Sunroad’s response was that the company complied with all city regulations and it kept working on the office tower.

    Finally, on May 17, 2007, Mayor Sanders held a press conference to announce that he was issuing yet another stop work notice. It is still unclear why the first two were not enforced or why seven months elapsed between the issuance of the first stop work notice and this one.

    Mayor Sanders also announced that he had written a letter to the FAA and California Department of Transportation acknowledging their concerns. However, he proposed a “solution” that would allow Sunroad to exceed a building height of 160 feet by “working with the FAA to discontinue circling instrument approaches north of the field and allowing aircraft to circle to the south.” Simply put, Mayor Sanders proposed changing the flight approach used by the pilots to accommodate Sunroad.

    As the elected official representing the district in which the Sunroad office tower is located, I am requesting that the mayor change course and support the following actions:

    First, protect the public and require Sunroad to remove that portion of its building that exceeds 160 feet.

    The FAA has determined that the portion of the Sunroad office tower above 160 feet is a hazard to air navigation. I oppose the mayor’s proposal to the FAA allowing Sunroad to exceed a building height of 160 feet and modifying the approach used by airplanes landing at Montgomery Field. The mayor’s proposal -- to require the pilots using Montgomery Field to change their flight approaches to accommodate a developer that ignored the law -- makes no sense.

    Second, put public safety first and do not allow people in the building to work on tenant improvements. Enforce a complete stop work notice.

    Third, do not allow the city's Development Services Department to issue any occupancy permits nor allow Sunroad to make interior improvements to the building. No one should be allowed in the building until the matter is resolved.

    Fourth, require that Development Services not approve any further Sunroad office towers under Substantial Conformance Review (SCR). Instead, require Development Services to prepare an amendment to the Sunroad Master Plan and a supplemental Environmental Impact Report for the project. If Sunroad still wishes to proceed with the project, the subsequent review will result in a true public vetting of the project and the ability of all agencies, including the FAA, to comment before issuing any building permits.

    Finally, the mayor must include the public, the city attorney and the City Council in any proposals he makes to the FAA and/or Sunroad. Neither he nor his staff should be unilaterally negotiating any proposals, especially if they include allowing Sunroad to benefit from not following the law. The public has a right to expect that their safety will have priority over developer profits, and that Sunroad will be required to comply with the law.

    Thank you Donna. Your leadership is refreshing. You are correct. The Mayor can stop this hazardous situation if he wants. It is disconcerting to hear Mayor Sanders state he has no control or authority over the matter, and he will wait for the courts to decide.     Sanders has bought into Sunroad’s position 100%: that the FAA has no land use authority over this project; that the FAA must either accommodate this development in its flight regulations or close the airport. Sanders authorized that illegal permit on July 7, 2006. DSD staff did not make the decision. The taxpayers are now on the hook for $45 million. Sanders has no intention of clamping down on Sunroad. The City Council, on behalf of the taxpayers, has to find a way to enforce the Municipal Code. If Sanders can do it for Sunroad, he will do it for others.

    Man Donna-I would have LOVED to vote for you-and this letter proves why-but that sales tax increase you planned was the deal killer. Here you rightfully point out that Sunroad BROKE THE LAW and we should not cave in to criminals when they BREAK THE LAW-and I agree 100%. Now, if you will conceed that the pension board BROKE THE LAW by breaching their fiduciary duties to their members and the public by allowing the underfunding (and therefore void all the illegal Cadillac pension gifts) we could get you into the Mayors office......Anyway, they tell me here at the VofSD that I am a broken record on the pension scam, so I will end it here.

    Re Billy Bob Henry's letter, unless you did so by sneaking across the border, then we are supposed to cave in. Having followed this in the newspaper primarily, what did I miss. Exactly what "law" did Sunroad break? As I understand it, it appears that the regulatory agencies dropped the ball. Perhaps Sunroad may have exceeded the permission granted to put the roof on, by also putting up exterior walls, but the stated aim was to weatherproof, and those walls do not put the public in any further danger (this enire matter is suppose to be a public safety issue, right?).

    Kudos to Ms. Frye for plain speaking on the Sunroad issue. Now that she has spoken, can the residents of Clairemont except some help from her with OVO (0versized Vehicle Ordinance) and protecting the public safety by removing big rigs, RV's, and old boats which park forever on main thoroughfares like Morena Blvd. ? Supposedly Mayor Sanders does not want to proceed with the OVO. Nothing has been done on it since 2005. Do we see a pattern here ? New cause for Donna if she is truly interested in public safety.

    A simple "STOP WORK" order was in Sanders power, and was in fact issued twice before! This simple little decree, enforced of course, would have prevented so much controversy and saved so much money in legal fees! We would not have (at least to the extent we did), Aguirre v Sunroad, Aguirre V Story, Aguirre V Lansdowne. That was a costly mistake by Sanders! Or maybe Sanders lack of action was intenional because he knew Aguirre would find a way to make himself (Aguirre)look bad!

    Wouldn't rerouting planes to the south mean that they're flying over residential? Low flying planes, in bad weather, over people's homes? Yeah, that makes sense.

    Developer disregard for public safety around airports is nothing new to San Diego, just look at the concrete abomination on Laurel Street. Maybe if enough high-rises are built around our airports those airports will be deemed "unsafe" and have to be moved. Their land will be available for development and the developer-owned lands in areas suitable for airports will become more valuable. hmmmm...

Jerry is the mayor for the wealthy, the business sector that sees only money-money-money, the power-base who can push other candidates out to the fringe, the developers controlling the land under your feet. People deserve a government run of, by and for the people, not of the rich, for the rich by the rich -- the wealthy are only a tiny percent of the population, but they have access to and control of the government in ways normal folks can't even dream of. They use our local government to enhance their private businesses -- for example, that is exactly what they are doing with the building department -- DSD is being made to streamline the developers' permitting process to slide in projects without public review!

    Isn't ironic that this mayor was going to cleanup city corruption? Isn't ironic that dog parks can go without lights at night, parks that many people use and yet it is alright to build a building which is a hazard to the public. Lobbiest of Sunroad putting money in the mayor's campaign pocket or just his pockets? More money seems to be what our mayor is all about, not the people that voted him in. Of course, Donna Fry got my vote, not Sanders. Is it a wonder why?

    This is just another example of the Mayor Sanders ineptness. This was a no brainer early on, but now it will lead to costly litigation that the City really does not the budget for. Perhaps the attorney fees should be offset against Sanders pension.

    If the voters in San Diego really wanted the city cleaned up and run fairly, they would have voted for Donna Frye. The current management team is Susan Golding Version 2.0 - with Kris Mitchel and Fred Sainz returning (but not upgraded)..and a bevy of highly paid new hires to run department therepy programs to define missions and goals and sategy...AUGHH! AGAIN. Anyone remember Zero based budgeting? Park and Rec could tell you how much a cubic meter of grass cost to mow. And now they say that there are no measurement standards in place? The council must demand correct information given to them by staff...but as long as those staff report to the Mayor, that information will be tainted by his private agenda...re election and more hinky development schemes..can you say blighted Sports Arena?

    On this subject, the Mayor reminds me of the police Capt., from the movie Casablanca. Jerry is shocked and dumfounded that "gambling" has been going on at Rick's saloon. Same thing with the Sunroad building. Now that it is up---he can't believe that it happened. Jerry and his people knew what they were doing. They got it up and he ain't going to let it come down. Wasn't Jerry Sanders supposed to be the ethical and transparent Mayor? When does that campaign promise begin? I guess after Ms. Froman completes her "nobody did anything wrong, it was a systemic failure" investigation. A big thank-you to Donna Frye. Her uncomplicated, candid, way of conducting city business should be the model, not the exception.

    Great job Donna! I see Billbo wants to discredit you by criticizing your campaign, but what else is new; try and stay on the subject Billy Bob. Remember Billbo, Sunroad broke the law as you say but his actions were facilitated by the Mayor and his staff who are complicit in this crime. Donna, your comment about putting public safety first is absolutely true but the Mayor has proven that public safety is at the bottom of his list of priorities. This case defines the real Jerry Sanders who hasn't met a developer he didn't like or didn't pander to. Keep up the good work protecting the citizens

    I agree that this city got what it deserved when it did not elect Donna Frye. I remain hopelessly naive to think that people do not care about public safety. Of course the city (substitute Mayor) fiddled while Rome burned. Now it is harder to pull those 20 feet down. I will be happily astonished if that ever happens. Good luck San Diego--another bonehead situation. Will the voters ever learn?

    San Diego Business Journal August 1, 2005 Designed by Brian Paul & Associates, the first phase, expected to be completed in the first quarter of 2007, will offer about 300,000 square feet of office space in a 12 story reflective glass tower above one level of subterranean parking. Funny how the San Diego Business Journal writes about the lack of empty land and also appears to have written the earliest news story mentioning a 12 story tower.

    Isn't it interesting that Sunroad is so self-assured that they have the city's support that they propose 2 more buildings next to an airport that exceeds FAA height regs. What are the odds that Sanders and Co. ignore this one also until it is to late to do anything.

    It may be that raising the ambient average temperature even half a degree Centigrade causes lighter human brains to tilt to the right, a position which may encourage carelessly inhumane behavior, but promote the assumption leadership. It would allow terrorists or public officials (anyone craving power) to actually conspire to build a building so an innocent pilot could create a public disaster, which is clearly a great advance on the crude efforts of 9/11. This little known behavioral effect of global warming doesn't seem to effect people with adequate history of exposure to conditions such as those found at the beach. Donna for President. Surfers rule.

    There must always be compromise and balance between the values of public safety vs. economic development, public safety vs. protection of the environment and public safety vs. civil liberties. Think people. Is this editorial really about advancing public safety or is it about advancing anti developer political ideology? The CDF has been clashing with local government for years about the conflicts between preserving habitat and fire hazards. Were the supporters of environmental protection vilified for not heeding safety warnings issued by that state agency when the wildfires hit and caused great devastation? It’s disgusting. San Diego has denigrated to governance by politics of vilification. Only the political junkies love it.

    I don't think it's about advancing anti developer political ideology. If Sunroad had said "ok, you got us we'll fix it" everyone would have shut up. It's the fact that they freely lie about what they did and didn't do, and repeat over and over that they don't care what any government agency says because they know best. I like the CAASD attorney's analogy - when you catch a bank robber you don't tell him he can keep 90% of what he stole. Rather than think the mayor is in Sunroad's pocket, I believe he and his staff support them because they see it as the first nail in Montgomery Field's coffin. Reduce the airport's utility (by removing the instrument approaches), lower the amount of business and emergency traffic it gets, no longer any need for it. And if they get lucky and someone hits the building before that...

There is NO compromise on human life. Whats next, are you going to tell us the public must have compromises on criminals and public safety??? Sunroad is a criminal in my book, and as such they should be treated no differently than the guy sticking a gun to your head demanding money.....

    Yo Stan -- Montgomery Field produces more economic development than anything Sunroad will ever build next to the airport. Also, the San Diego private sector is not hurting so bad that it MUST have the Sunroad project as is. Indeed, the private business sector is humming right along, more or less oblivious to the public funding crisises and our struggling middle and lower class families. You said the cliche, "balance between the values of public safety vs. economic development," well Sunroad loses against the airport. Unless you think you gan get more property tax for the city and massive lease and sales profits for the private sector by scraping off the airstrip and slapping down development projects. In that case we have a new circumstance: Balancing the Needs of the Citizens vs. Special Interest Developer Profits.

    You can say what you want, about Mike Aquirre and Donna Frye, but they have proven (once again) they are the only 2 folks employed by the City of San Diego who you can trust! I thought Jerry Sanders would be different, but the Sunroad dealings prove (once again), it's just more of the same back door deals with developers. I've seen, and have first hand experience, with the corruption inherent in the City's project approval process. Don't be fooled by what is said and agreed upon at these "public" meetings & hearings, because you'll soon be sorely disappointed, when you finally come to realize that the real decisions are made behind closed doors without any public input or oversight. Com'n Jerry, no more crooked cops or politicians!

    Donna is in her element, armchair quarterbacking as usual. She never takes the initiative, just sits back and complains about others. At least Aguirre takes action. Wrong and incompetent action, but action nonetheless. Perhaps they are a good, balanced pair.

    Donna has been a clear supporter of the airport and has been working behind the scenes to help stop this crazy building. I dont know how Sunroad will be able to get insurance for their bulding. How do they think someone will lease the building when they cant get insurance because sunroad is again doing illegal things and trying to take advantage of the city. Finally we are stopping the madness!!!

    Yep, I've said it before and I will say it again, Donna should be Mayor. When is the city of San Diego going to put a stop to these corrupt developers who insist on doing business their own way? OOP's, in order to do that, San Diego has got to put a stop to its corrupt politicians. Who ever heard of Clowns like these being able to thumb their noses at the FAA and build a, To Tall Building, next to an airport and then plan a couple more monstrosities for downtown. San Diego is like a dope addict, they have to hit bottom before that can start a recovery program. Well from the looks of our sewer system, water pipes, and roads, the bottom must be near.

And although Donna has many qualities this City needs desperately-she was going to rubber stamp the pesnion scams by raising taxes, and no one is going to go for that when these pension scams are in place. That is the only reason she lost-Sanders promised not to raise taxes (and lied it looks like), while Donna said she was going to raise taxes. We need to file BK before we raise taxes for the benefit of corrupt Gov unions/employees. The worst part is Sanders has not done a thing to rein in the pension scams-and that should be priority #1 for this City.

    Drove by the building today and for the first time noticed the huge gash in the building from bottom to almost the top where there is no exterior. Can anyone explain why, when there was an urgent need to weatherise the building they left the 160 x 20(?) feet hole in the side - doesn't that let the rain in too?

    BRBBH, I definitely think Bankruptcy is the answer and it was even mentioned at a Board of Supervisors meeting several years ago and I liked the idea then and I like it even better now. Yes, the unions are like a bunch of drunken sailors on a three day pass, but we are supposed to have a city government with a strong Mayor to handle these situations. Like you said, Donna did say she would probably raise taxes and Sanders said he would not. So, we either get a Mayor that lets you know where she stands up front or one that lies and can't make decisions. Besides, Donna is a surfer and that's good enough for me.

    Donna Frye postures for the cameras but is uninformed about her own council district. At yesterday's San Diego Housing Commission hearing she asked a staffer (in her usual snotty manner), "Is there affordable housing in Mission Valley ? I know of none." Ding Dong. Donna was wrong. How can we expect a person who doesn't drive but is driven by her staff to really know the nuts and bolts of her district ? By the way are her drivers on the City dime ? Get a license and see the world, Ms. Frye.

    Roger Hedgecock had the Mayor on his show today and he said that pilots have to fly at higher altitudes in the vicinity of the Sunroad Monstrosity until the two floors are removed. Well Jerry, just when will that be? When Sunroad decides they want to do it. Come on Donna, since everyone else is dragging their feet on this one it's time for you to take charge and help prevent another San Diego air disaster.

    We certainly have had many of the similar issues confront us up here in San Marcos. I do not know who Billy-Bob Henry is, but I wish he would consider driving up to San Marcos on June 18th for a Planning Commission Public Hearing on the Palomar Station Project, which is purported to be a mixed-use residential project that will be dumped into the midst of the Business and Industrial Neighborhood of our General Plan. There are terrible health risks, which the consultants say are "unmitigatable" for the 1000 residents who will live there. The developer will have the residents sign waivers acknowledging those health risks and giving up their rights. Seems as if this might pique your curiosity. To boot, there are gnatcatchers on the sight as well as vernal pools with their usual creatures, and the thread-leafed brodelia. Please reply...

    To Billy-Bob Henry and anyone else out there who happens to be concerned about human beings, their health and safety, and the environment: To continue from my previous note, it is interesting to tell that we used to have a City Council that cared about people, about children, and about their safety. This Palomar Station Project was voted down by our City Council in 2004. It is back again, after lots of money was poured into 2 different council races. You know what happened. Money talks. Money from unspecified places, and you guessed the result, as you have seen repeatedly yourselves, that things have ony gotten worse. In the DEIR appropriate officials were not notified, but some of them commented anyway. The next big issue is that this project is planned adjacent to a large toxic waste spill. Come on down, please.

    Viva La Donna! What is quite clear is that Sanders is a puppet mayor at the hands of developers. This time at Sunroad he got caught in his long johns with his tail flap down. The other source of the problem is DSD's Escobar-Eck. Any contractor would know that you tarp the roof of an unfinished roof during inclement weather.... except a crooked one with wording prearranged with Development Services to leave the window open. This gave Sunroad the excuse to put a permanent roof on so they could sue the city if the city didn't cave in This isn't the first time Escobar-Eck has compromised public safety near an airport. Check out the FAA assemblies of people violations that are planned for Shoreline Plaza Runway Protection Zone at NTC (Liberty Station.)

    Hey San Marco's, just find out where the money is coming from and that's where you take the fight. You will no doubt fine a developer and a politician as your opponents. Contact your county supervisor and environment health. These are winnable fights. You just have to get your neighbors together and show solidarity. It's not easy going up against these clowns, but if you don't nobody else will and winning is so rewarding. Now go get em.
